The legal team of Nnamdi Kanu, leader of the Indigenous People of Biafra (IPOB), has made a fresh appeal to the Nigerian government.
They are calling for the release of Mr. Kanu on bail or for better conditions for his trial.
Mr. Kanu has been in detention since his controversial repatriation to Nigeria from Kenya in June 2021.
The circumstances surrounding Kanu’s return to Nigeria raised significant concerns.
He was arrested in Kenya, which many believe violated international law and Nigeria’s extradition treaties.
Since his return, he has faced terrorism charges that have drawn widespread attention and debate.
The legal team held a press conference in Abuja on Wednesday to discuss their demands.
Aloy Ejimakor, a member of the legal team and special counsel to Kanu, shared highlights from the press conference on his Facebook page.
During the conference, lawyer Jude Ugwuanyi emphasized that the federal government must consider the current insecurity in the South-East.
“If the federal government should consider the insecurity in the South-East and be aware that their primary responsibility is to secure the lives and property of the citizens, they should allow this man (Nnamdi Kanu) either bail or give him enough room to discuss with his lawyers to effectively defend himself,” said Ugwuanyi.
Ugwuanyi argued that keeping Kanu in detention contributes to the ongoing insecurity in the region.
He pointed out that many people in the South-East are suffering due to violence and unrest.
“I have lost a brother, who was a final-year law student, to this insecurity,” he shared.
He further lamented his inability to visit his village due to the prevailing violence.
Allegations Against the Judiciary
The legal team’s frustration has extended to the judiciary as well.
Justice Binta Nyako of the Federal High Court in Abuja recently withdrew from Kanu’s case after Kanu accused her of bias.
Ejimakor explained that Kanu’s request for her withdrawal stemmed from claims that she disobeyed a Supreme Court ruling allowing Kanu to be released on bail.
He stated, “The SSS (State Security Service) seizes our legal documents. The SSS listens to our conversations (with Kanu).”
Ejimakor pointed out that the lack of a secure environment has severely hindered their ability to prepare Kanu’s defense.
The legal team insists that under Section 36 of the Nigerian Constitution, defendants have the right to a fair trial and adequate facilities to prepare their defense.
Ejimakor continued, “That clean room was not provided. And the SSS continues to interdict our documents each time we go there.”
This situation has raised concerns about Kanu’s fundamental rights.
Another legal team member, Nnaemeka Ejiofor, reiterated that their request for the judge’s recusal was not out of disrespect but a constitutional right.
“Once you’re before a court and you do not feel your fundamental rights are being protected by the court, then you have the right to request the judge to recuse himself or herself,” said Ejiofor.
Nnamdi Kanu’s legal troubles began in 2015 when he was first arrested under former President Muhammadu Buhari’s administration.
In October 2022, the Court of Appeal in Abuja found that Kanu had been “extraordinarily renditioned” to Nigeria.
The court ruled that this action violated Nigeria’s extradition treaty and breached his fundamental human rights.
As a result, the court struck out the terrorism charges against him and ordered his release from the SSS facility.
Despite the court ruling, the Nigerian government has refused to release Kanu.
Officials claim that releasing him could lead to further insecurity in the South-East, where Kanu originates.
They argue that Kanu’s potential unavailability for future court proceedings is also a concern.
As the legal team pushes for Kanu’s release, they also continue to seek a fair trial environment.
Their demands highlight the broader issues of insecurity and governance in Nigeria.
The South-East has faced escalating violence in recent years, leading to fears and uncertainties among residents.
