NOGASA Chairman, Fatuyi Yemi Philips, Sentenced to 21 Years for N43.5m Fraud
In a landmark ruling, Fatuyi Yemi Philips, the Chairman of the Natural Oil and Gas Suppliers Association of Nigeria (NOGASA), was sentenced to 21 years in prison on Monday, November 19, 2024, for his involvement in a fraudulent scheme that defrauded his victims of N43.5 million.
The conviction was handed down by Justice Mojisola Dada of the Special Offences Court in Ikeja, Lagos, who found Philips guilty of obtaining the massive sum under false pretenses.
Philips was accused of defrauding Elochukwu Okoye and Elebana Unique Ventures Nigeria Limited, who had entrusted him with N43.5 million, believing they would receive the equivalent of $98,870.00 from him, a deal he had no intention of fulfilling.
The fraud occurred on September 28, 2016, when Philips falsely promised to sell the foreign currency on behalf of WAPCIL Nigeria Limited, a company that had no knowledge of the deceit. In the process, Philips failed to deliver the promised goods or return the money, leading to a legal battle that would last several years.
The case was brought before the Economic and Financial Crimes Commission (EFCC) in April 2022. Philips was arraigned alongside his company, Oceanview Oil and Gas Limited, on two charges of obtaining money by false pretense and theft. The EFCC prosecuted the case rigorously, presenting a wealth of documentary evidence and testimony from five witnesses.
Philips denied the charges, pleading “not guilty” and leading to a full trial. Despite his defense, the court was convinced by the prosecution’s case.
Delivering the judgment, Justice Dada expressed that the prosecution had proven its case beyond a reasonable doubt. She ruled that Philips’ actions had caused significant financial damage to his victims, with no remorse shown throughout the trial.
As a result, Philips was sentenced to 14 years imprisonment for the first charge of obtaining money under false pretenses, and seven years for the second charge of theft, to be served concurrently. The court also ordered his company, Oceanview Oil and Gas Limited, to pay a fine of N500,000 for the first charge and N250,000 for the second, or face dissolution.
“This is a clear message that corruption and dishonesty will not be tolerated,” Justice Dada stated in her ruling. “Those who think they can defraud others and escape justice will find that the law will eventually catch up with them.”
In addition to the prison sentence, the court also ordered Philips and his company to make restitution to the victims, Elochukwu Okoye and Elebana Unique Ventures Nigeria Limited, by paying $90,202.00, or its equivalent in Nigerian Naira, within the next 30 days.
The case has attracted widespread attention, highlighting the ongoing efforts by the EFCC to clamp down on corruption within Nigeria’s business sector, especially in the oil and gas industry.
Following the judgment, the EFCC expressed satisfaction with the outcome. The agency commended Justice Dada for delivering a judgment that sent a strong signal against financial crimes in the country.
EFCC spokesperson, Wilson Uwujaren, issued a statement saying, “The conviction of Fatuyi Yemi Philips is another victory in our fight against corruption. It shows that no one, regardless of their position, is above the law.”
Philips’ legal journey began when he was accused of convincing Okoye and Elebana Unique Ventures Nigeria Limited to hand over the money with the promise of a lucrative exchange deal involving foreign currency. However, after receiving the sum of N43,502,000.00, Philips failed to deliver on his promise, leading to the victims’ loss.
