    Lagos Reclaims Control Over Lotteries After Supreme Court Victory

    The Lagos State Government has secured a landmark victory at the Supreme Court, reclaiming its constitutional authority to regulate lotteries and gaming within its jurisdiction.

    This decision comes as the apex court nullified the National Lottery Act in a historic judgement that underscores the principles of federalism and the autonomy of states.

    In Suit No. SC/1/2008, the Supreme Court reaffirmed that lotteries and gaming are residual matters that fall under the exclusive purview of state governments.

    A Historic Ruling

    The ruling, delivered on Sunday, was hailed by Lagos State Commissioner for Information and Strategy, Gbenga Omotoso.

    Describing it as a “triumph for constitutional democracy,” Omotoso emphasized the broader implications of the decision for governance in Nigeria.

    “The Supreme Court’s decision affirms that the regulation of lotteries and gaming is a residual matter, squarely within the purview of state governments,” he stated.

    “This ruling reinforces the principles of true federalism, empowering states to chart their own regulatory frameworks,” he added.

    Praise for Leaders’ Vision

    Omotoso attributed the legal victory to the foresight and dedication of past and present leaders of Lagos State.

    He described the judgement as a testament to President Bola Ahmed Tinubu’s vision for restructuring and true federalism.

    “This is a fitting tribute to Tinubu’s progressive leadership and relentless pursuit of a more balanced federal structure,” Omotoso said.

    The Commissioner also praised former Lagos State Governor, Babatunde Raji Fashola, SAN, for initiating the legal challenge that culminated in this ruling.

    “Fashola’s commitment to resolving contentious constitutional issues laid the foundation for this landmark victory,” he noted.

    Omotoso further commended Governor Babajide Sanwo-Olu for his unwavering dedication to upholding the rule of law and defending the rights of Lagosians.

    With this ruling, the Lagos State Lotteries and Gaming Authority (LSLGA) is affirmed as the sole regulator of gaming activities in the state.

    The Commissioner urged illegal operators to regularize their businesses with the LSLGA or face prosecution.

    “The Lagos State Government will continue to foster a conducive environment for legitimate businesses while protecting residents from the adverse effects of unregulated gaming,” Omotoso said.

    He highlighted the gaming sector’s potential to significantly boost the state’s economy and improve the prosperity of its citizens.

    “Under proper regulation, the gaming industry can serve as a major revenue source and drive sustainable economic growth,” he added.

    A Victory for Federalism

    Legal experts and stakeholders have lauded the ruling as a significant step toward strengthening Nigeria’s federal structure.

    The nullification of the National Lottery Act is seen as a precedent that empowers states to take control of matters traditionally encroached upon by the federal government.

    “This judgement is not just about gaming; it’s about federalism,” said constitutional lawyer Emeka Adibe.

    “It sets a powerful precedent that states have the authority to govern their own affairs, especially in residual matters,” he added.
