Defamation: Another Lawyer from Afe Babalola’s Firm Sues Dele Farotimi for N600 Million

Dele Farotimi, a controversial author and legal practitioner, is facing another libel lawsuit, this time from Ola Faro, a lawyer at Afe Babalola & Co., one of Nigeria’s most prominent law firms. The suit, filed in the Rivers State High Court in Port Harcourt on December 11, 2024, is demanding N600 million in damages over alleged defamatory statements made in Farotimi’s book, “Nigeria and Its Criminal Justice System.”

The Legal Action Against Farotimi

In a detailed petition, Faro claims that Farotimi’s book falsely portrays both him and the esteemed founder of Afe Babalola & Co., Chief Afe Babalola, as corrupt and unethical in their dealings with the Nigerian judiciary. Faro asserts that Farotimi’s statements aim to undermine the law firm’s reputation and cause irreparable damage to its standing in both the legal community and society at large. He is seeking N500 million in damages for defamation, as well as an additional N100 million for the distribution of the book.

Furthermore, Faro has requested a permanent injunction to prevent Farotimi and his agents from further distributing the book, alleging that the contents are malicious and intended to tarnish his and the firm’s reputation.

In a previous legal action, Kehinde Ogunwumiju, a Senior Advocate of Nigeria (SAN) and managing partner at Afe Babalola & Co., filed a similar libel lawsuit at the Federal Capital Territory (FCT) High Court in Abuja. Ogunwumiju obtained an interim order for the seizure of physical copies of the book, with the FCT High Court set to hear further proceedings. Ogunwumiju’s claim in that suit sought N500 million in damages for defamation and related harm to his professional standing.

Criminal Charges and Defamation Allegations

In addition to the civil lawsuits, Farotimi is also facing criminal charges in two different courts. These charges, which include criminal defamation and cybercrime, stem from complaints filed by Afe Babalola. In the petition, Babalola alleged that Farotimi’s book made defamatory statements about him, accusing him of corrupting the Nigerian judiciary and specifically manipulating the Supreme Court for personal gain.

As a result, the police have charged Farotimi with defamation and cybercrime, with the cases currently pending in a chief magistrate’s court and the Federal High Court in Ado Ekiti, Ekiti State. On December 14, 2024, a Federal High Court judge, Babs Kuewumi, granted Farotimi bail, set at N50 million, and postponed the trial to January 29, 2025. Meanwhile, the chief magistrate’s court is scheduled to rule on Farotimi’s bail application on December 20, 2024.

In Faro’s view, these allegations are completely unfounded and designed to malign both his and Babalola’s reputation. “The statements made in Farotimi’s book are false and defamatory. They seek to tarnish the integrity of our law firm and its esteemed founder,” Faro stated in his petition. He emphasized that Farotimi’s intention was to create a narrative that damaged the reputation of Afe Babalola & Co., thus undermining the public’s trust in its legal services.
