    Judges Must Have Homes To Retire To – Wike Defends Controversial Stance

    The Minister of the Federal Capital Territory (FCT), Barrister Ezenwo Nyesom Wike, has emphasized the critical role of judicial independence in sustaining Nigeria’s constitutional democracy.

    Wike, speaking at the 2024 Annual Court of Appeal Justices Conference in Abuja, highlighted that the judiciary must operate free from external interference to protect its integrity and preserve democracy.

    “The court can neither safeguard the personal liberties of the citizens nor protect and defend the constitution against infractions unless it is independent of the legislative and executive arms of government, including other individuals, groups, and institutions,” Wike stated.

    Delivering a paper titled Judicial Independence, Wike outlined the importance of the judiciary’s role in ensuring that the legislature and executive adhere to constitutional limits.

    The Minister stressed the need for courageous judges who can discharge their duties without fear of criticism or intimidation.

    “You cannot do your work without people criticizing you. We have all kinds of strategies to ensure cases do not proceed. But you must be a courageous judge to stand firm,” he advised.

    Wike called for robust systems to preserve judicial independence, including proper procedures for appointing judges, securing their tenure, and ensuring financial autonomy for the judiciary.

    Housing Key to Judicial Independence

    A key highlight of Wike’s address was his advocacy for improved welfare for judges, particularly in housing and remuneration.

    “When a judge is retiring and has no home, that judge will be tempted to do one or two things,” Wike warned.

    He pointed out that providing decent housing for judges on an owner-occupier basis can strengthen judicial integrity.

    Sharing his experience as Governor of Rivers State, Wike noted, “I made it mandatory that no judge would retire without having decent accommodation. Some opted for housing, and others wanted monetized options.”

    The Minister revealed that a similar initiative is now underway in the FCT to ensure every judge retires with a home.

    “This is a factor I recommend to both state and federal governments,” Wike said, adding that housing security for judges will bolster their independence and reduce susceptibility to unethical pressures.

    Wike praised President Bola Ahmed Tinubu for approving an enhanced salary structure and pension for judicial officers. He expressed confidence that the move would further protect judicial independence.

    “With this, judges will be encouraged to guard their independence jealously,” Wike remarked.

    However, he noted that the judiciary also has a responsibility to resist any attempts to undermine its autonomy.

    The Minister’s speech underscored the essential link between a stable judiciary and a stable democracy.

    “The judiciary must act as the watchdog, ensuring that the executive and legislature stay within their constitutional boundaries,” Wike reiterated.

    He concluded by urging judges and government officials to work collectively toward safeguarding judicial independence.
